General Disclosure

The programs provided by the McCracken Institute, LLC and McCracken Alliance Corporation and its affiliates (the "Company") are designed to share insights into some of the numerous aspects of the roles and responsibilities of the Office of the CFO as defined by the Company. Advancement of participant to more effective current roles in business or as an opportunity to achieve higher level finance roles is solely the responsibility of each program participant in their relative circumstances and the Company does not profess to cover all the necessary aspects of assuring a participant is or will be successful in executing any of their roles and responsibilities in application of the matters and concepts discussed in the Company programs. The educational aspects of the program referenced herein are not designed or intended to qualify a participant for employment or advancement opportunities. It is intended solely for the avocation, personal enrichment, and enjoyment of students.

The Company’s products (including but not limited to training and coaching materials) are for education and/or illustration purposes only and are provided with the understanding that the Company is not engaged in rendering legal, accounting, or other professional opinions. All content and course materials and discussions that are presented during the program have been collected and presented with the best knowledge and intent possible. This in no way reflects a guarantee of success. No results or examples mentioned by the Company, guest lecturers or other participants should be relied upon as other than one of many forms of insights which should be considered in deciding any actions taken by a participant based upon their own circumstances. Any financial numbers referenced in connection with our programs are illustrative of concepts only and should not be considered otherwise. Making decisions based on any information presented regarding products, events, services, or web site, should be done only with the knowledge that you could experience risk or losses by acting upon any suggestion mentioned in the program just like in any business endeavor. Use caution and always consult your other outside and internal professional advisor before acting on any information related to the program and the concepts discussed. Each participant alone is responsible and accountable for their own decisions, actions and results, and by a participant registering in the program they are agreeing not to attempt to hold the Company or its guest lecturers liable for your decisions, actions or results, at any time, under any circumstance.

Copyright Policy

All of our materials presented in the program are copyrighted. Any unauthorized reprint or use of our materials is prohibited. No part of our materials may be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying, recording, or by any information storage and retrieval system without the express written permission of the Company.

Additional Disclosures

You agree to hold the Company and our representatives and guest lecturers harmless from any and all liabilities, demands, claims, actions or suits that may be asserted against you by a third parties by reason of your use of any information presented in the program.

Miscellaneous

1. Severability. If any provisions in the Agreement or these Terms and Conditions are found to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force without being impaired or invalidated in any way.

2. The Agreement and these Terms and Conditions supersede any and all other agreements, either oral or in writing between you and us with respect to your purchase of the program noted in this Agreement and contain all of the covenants and agreements which pertain to such purchase. You hereby acknowledge that no representations, inducements, promises, or agreements, orally or otherwise, have been made by us, or anyone acting on behalf of us, which are not embodied herein, and that no other agreement, statement, or promise not contained in the Agreement and these Terms and Conditions shall be valid or binding on us.

Limitation of Liability to You

All implied warranties, including but not limited to implied warranties of Merchantability, fitness for a particular purpose, and non-infringement are hereby disclaimed. We shall not be liable for any incidental or consequential damages. Our liability under the agreement and these terms and conditions is limited to the unused portion of the price you paid for the program or services that are the subject of a dispute or controversy. In no event shall we be liable for any losses of profits or any other commercial damage, including but not limited to special indirect, exemplary, incidental, consequential, punitive or other damages. The terms “Company,” “we,” “us,” “our,” or “ours,” as used only in this paragraph shall include our parent entity, subsidiaries, affiliates, officers, directors, shareholders, employees, agents, licensees, successors and assigns.

Refund Policy

Due to the significant effort involved in planning and customizing our programs, all payments for our programs are non-refundable. This includes the time and resources spent on creating tailored content, arranging presenter logistics, and preparing materials specifically for each participant.
